Legal Question in Insurance Law in New York
apartment fire
My apartment was destroyed in a fire ( I rent). The insurance company is now claiming that neglect on my part caused the fire, and is now suing me for the cost of the renovation. I know the fire was an accident. I do not own any property and have a low income. I am prepared to fight this, but I am curious as to how the courts have ruled in similar cases. Thank you!

I am assuming the insurance company for the building is suing you for negligence. Your question as to how courts have ruled is difficult, in that every case is different and stands on its own facts and circumstances. There should be a fire marshal's report which states the supposed cause of the fire. If you have renter's insurance than your insurance company should be defending you. The strength (or weakness) of your case depends on what the specific claims of negligence are and your defenses. I would be happy to speak with you to discuss this in more detail.
