Legal Question in Intellectual Property in New York

I have photos posted on my company's Facebook page with a disclaimer on the album that the photos are the property of my company. An online news agency posted one of my photos and the reporter took the credit for the photo without my permission (apparently my client's PR person copied the photos and sent them to the news agency). I even sent an email to the PR guy that if the photos were going to be used, my company was to get full credit for the photo. Am I in my legal right to file a small claims case and if so, against who?

It appears that the PR person and possibly the online news agency violated your copyright rights, and possibly invaded your privacy and misappropriated your likeness. I'm afraid that it is unlikely that your email will motivate the PR person and the agency to compensate you. You should consider retaining an attorney who will send an attorney demand and who will possibly set the claim higher than small claims.
