Legal Question in Employment Law in New York

60-days notice of termination

I am required to give 60-days notice to my employer before leaving. During that time I am not supposed to work for another employer. Can my current employer find out if I start working for another company prior to that date?

Re: 60-days notice of termination

Yes he can. Will he? I have no idea. Usually a non compete clause will have a mileage clause too. If it is reasonable, then the non compete is legal. Your failure to follow it could result in a law suit against you and your new employer.

If you want to talk about this some more or if you want to challenge your non compete clause, contact me at the links below.

Good luck.
