Legal Question in Employment Law in New York
Discharged with good performance reviews
I was recently fired from a position in which I had good performance reviews. I expressed my opinion on a policy in which management viewed as unprofessional. I understand that my position was ''at will'' and could be terminated at anytime for any reason. This seems to give the company too much power over employees who may disagree with management or policies. Does a person have any recourse in this situation? I recently read an article in the April 23, 2007 edition of Business Week that suggested employees may have certain rights in this area, since ''at will'' is not clearly defined. Please clarify

Re: Discharged with good performance reviews
There may be an implied contract based upon your positive performance review, but that can be a tenuous argument.
Assuming you were terminated solely for a non-discriminatory reason, your best bet may be to attempt to maximize any severance benefits and compensation.
You can visit SeveranceAttorney.com or contact my office via email for a consultation about how we can help you maximize your severance benefits.
Good luck!
