Legal Question in Employment Law in New York
Can I take an employer to court for money owed to me, I was on the books at first then taken off because she could not afford payroll. She told me she would still pay me for coming into work with cash and put me back on when she can. She owes me 5000.00, and the situation is not being resolved.

Yes, you have the option of suing her in small claim court to resolve the matter quickly.
In the alternative, you have state and federal laws that allow you greater compensation than $5,000. However, this will take time. If you are short on cash, the small claims option may be the best alternative. In addition, you can also try to get this resolved through the Department of Labor. However, they are overloaded at this time because of the number of claims.
