Legal Question in Employment Law in New York
Harassment at work
I was called into the owners office and he had a few complaints about me. I work in a small office with 3 women and 2 men. There were 3 complaints he gave as examples of possible harassment. I was on the phone with a company that fudged a few orders, when I got off I said out loud ''this would be a lot easier if these bitches would do their job.'' One woman has said I directed it at them, even when I told her who I was directing my comment towards. #2 was when I got several complaints and irate calls to me about one employee not shipping out items (4-8 weeks late, some more). I mentioned in a kidding but serious way that we needed to take care of the customer better and she was getting me yelled at, I said should we punish you like I do with my 2 kids ''put you over my knee and get a spanking''. We all laughed and she even pretended like she was going to walk over to me, she did not lay over my lap.
The other incident was the other day as I opened a door she was turned away from me and in the way of the door swing. I made sure as I swung it open that it didnt hit her, she asked what I was doing and I said ''making sure I dont hit you in the butt.'' After the meeting I was given a strict warning. Is it harassment at all?

Re: Harassment at work
Yes. You sexually harassed your co-workers. Your behavior is immature, inappropriate, boorish and I believe violates anti-discrimination laws. If you were my employee, I would fire you.
