Legal Question in Employment Law in New York

Our small company located in New York city is in need of some advice as to how to let go of an 80 year old technician, who does not show respect for the owner of the company, refuses to follow policies set up, continually compares existing owner to previous owner. He is more of a liability now because he has health issues, and our company is in the fabrication business, we have from time to time had health scares on the job, he is an insulin dependent diabetic, and his work output has considerably lessened. Considering that NY has no mandatory retirement age for the private sector, we are left with this dilemma.
