what are my rights as a tenant as far as eviction?
My landlord is in a nursuing home, her neiece is supposed to p/o/a of the estate.I'm not sure.I visit my LL,the neice has been collecting rent since the aunt went into the nursing home 8/05.I found out recently that the neice has not paid any unilities, the mortgage no bills.I went & paid on the light bill because the lights was due to be turned off the neice did not want my rent.Once I told her what I did she got very nasty & stated that she will burn my 8yr daughter & I out of the basement.She just wants us out.I told my LL what the neice is up to about selling the house & not paying any of the bills the LL has not a clue to what is going on. She is fully of sound mind.I came home this morning & found a supposed to be eviction notice.There is no cause, my daughter's father doesn't even reside here any more & his name is on the paper.It states that I have 30 days to move. It has no seal, no court nothing on it a regular blumberg stationary. But she came by Thursday 2/23/06 & collected $400. But I noticed it was on a different receit than the normal ones usually given. The gas is about to be turned off nest week because of non-pymt, the lights will soon be shut off & the steps are broken I feel through 2x. What can I do?

There are many rights you may have to prevent the landlord's attempts to evict you. Firstly from your description it seems that you received a notice to vacate rather than an eviction notice. Only the court can issue an eviction notice and it must be a warrant that is signed by a judge. You may have additional rights if the basement apartment you describe is not a legal rental unit. Go to your local housing court, find out if the niece's action is really on the calendar (my guess is it isn't) if it is make sure you appear on that date, you have valid defenses and in addition file an order to show cause with respect to the condtion of the apartment.
By the way if the lease is not the landlord of the apartment, she may not have a right to collect rent.
Additionally by collecting the money, she has no right to evict you absent some other violation of the lease.
Finally, it may just not be worth it considering all the headaches perhaps for your safety and sanity you should consider finding another place to live, whatever your rights with respect to your current apartment.
If you have to pay more rent as a result of her breach of the lease, you may be able to sue your landlord (or his representative) for their breach of the lease for any difference you may have to pay in rent.
