Legal Question in Landlord & Tenant Law in New York

If a tenant has recieved a 3 day notice and 10 day grace period to work it out with the landlord,which failed.How does the next step legally take place, must it be handed in person,can it be taped or mailed to your house. I am currently away from my home and concerned that they may go to court without me,can that happen?I am an american with a disabilty and on social security, my main concern again is I am away from home and want to know if they can go into court without me,how must I be notified?

The notice of petition and petition for the nonpayment proceeding may be served by a copy of the pleadings being taped and mailed to the house.

A. Yes. You should have someone to check your mail and your apartment.
