Legal Question in Legal Ethics in New York

Lawyers ability to practice without bar admission.

If an individual has graduated from law school but has not taken the Bar, can he hold himself out as a lawyer, attorney; both, or none. Also, what are his limitations. I know he cannot represent someone in court, but can they draft contracts, give legal advice, etc.

Re: Lawyers ability to practice without bar admission.

The unauthorized practice of law is defined as providing legal representation/advice without being licensed to do so by the State in which the activity is performed.

The actions you describe are the unauthorized practice of law except to the extent the services provided are those authorized to be provided by a paralegal under direct lawyer supervision.
