Legal Question in Medical Malpractice in New York

In which state should action be filed?

January 31, 1999 I experienced a seizure while visiting New York. I was taken to a local ER. Twenty one years earlier I has a similer experience and had been on anti-convulsant medication since, The drug level was sub-theraputic so the ER assumed this caused the seizure I was discharghed back to my hotel room and left to find a way back to my home in Oklahoma. I was extrememly ill and in fact had a massave hemorrhage within my brain caused from a congenital malformation. It took overr a month to get follow up afer returning home. I had brain surgery two weeks ago and have not been able to work since the event in January. Question: Do I find a lawyer in New York or my home state?

Re: In which state should action be filed?

You are going to have to file any case in New York. The statutte of limitations is two years from the date of the injury almost without exception.

I work with several good New York lawyers. Give me a call or e-mail to discuss your case.
