Not sure. Like most medical malpractice cases, the records would have to be gathered and given to another surgeon for evaluation. If there was a departure by your surgeon from the standard of practice, and that is what caused your current condition, you have a theory and possibly a successful case. But a bad result alone does not mean there was medical malpractice. Finding out is costly. There is the medical chart plus the doctor's time. And no guaranty the doctor will find any departure. Most attorneys will ask the client to defray the upfront costs associated with finding out if there's a theory. Expect to pay thousands. Best, M. E. Zuller
