Legal Question in Medical Malpractice in New York

I have been visiting a clinic in my area since 6/2/10. Since then I have been feeling sick on and off with about four ER visits. Last year I was informed that my white blood cell count was high but nothing was done or requested by the Dr. I always felt like I was being rushed out, not one was I checked physically by the Doctor. I only had blood pressure and heart rte checks by the Nurse. I recently made an appointment and was seen on 4/30/12. I asked the Doctor about blood work done in 10/2011. He just told me that my liver enzymes were elevated and he was going to run additional tests, no explanation of the test. I asked him why I was not informed and he just said the test was done before. Confusing response I thought to myself. I received a letter on the 12th of May 2012 stating that my results were abnormal. I then ended up in the ER for severe pain on my right side the day before my follow up appointment which I scheduled. I then was told it was a kidney stone on my left side which was seen in a catscan. I wan not satisfied because I had a stone before and am aware of the pain, this pain was different. I was discharged with pain medication and given a referral to the Urologist. On 5/14/12 I attended the appointment with my Doctor. The Doctor asked me why I was there and I began explaining about my trip to the ER. the whole time the Doctor as typing in his computer as I explained to him that I believed that the ER made a mistake. He just gave me a referral to Urology and asked me to wait outside for the referral. I then told him that I was sent a letter about my labs being abnormal and he then sat down to check them. That is when he told me that he believes I have been exposed to Hepatitis C. I tried asking him questions and he stated that he did not know and did not want to misinform me. I was told with no compassion and no explanation or even a little bit of information. He just gave me another referral to gastroenterology and told me that the Specialist would answer my questions. I saw the Specialist on 5/16/12 who happened to be very helpful and even suggested that I find a new Doctor. I then went back to request all my blood work and have found that my labs have been abnormal since 6/2/10. Not only were my enzymes and white blood count high. I found that my lymphocytes, monocytes, protein and globulin were high. In addition my bilirubin is low. I was never informed and feel like I have been neglected. I would appreciate any feedback from someone.

Thank you,

Ms. Rivera

You discuss undisclosed abnormal lab findings but don't say whether there was a missed diagnosis. If you were, or are, suffering from a medical condition that went undetected, and the injuries are severe or permanent and could have been prevented if the condition was properly diagnosed and treated, there might be something to pursue here.
