Legal Question in Personal Injury in New York
I currently have a lawyer to represent me in a car accident I was in Dec/2010. I was rear ended by the driver and he was arrested for DWI. I feel my lawyer is holding back or not working hard enough on my case. I have been to chiropractors, EMG and MRI's done and such covering a six month period. My lawyer told me that my first offer was $200...now it's up to $1000. Is there anyway to verify if that is the exact amount and/or if I can change my attorney here in NYC. At times when I call she speaks generally about my case and I correct her on some facts and she back tracks...I feel like I should have the right to fire her if she isn't working in my best interest...I feel stuck in the mud

Yes, you can fire your attorney at any point. However, there are costs for doing so.
Check your retention agreement to determine how much you will owe her if you fire her.
There is no guarantee that another attorney will make the matter go any faster.
You may want to sit down with her to tell her how your reel about her work on the case.
Good Luck.

You can always change attorney. If you can find another attorney to take your case, they should be able to work out the transfer of your file. You pay one legal fee. The attorneys will work out a fee arrangement between them.
Yes. You are free to choose another attorney at any time. Feel free to contact me directly, if you wish a free consultation.
