Legal Question in Personal Injury in New York

Legal fees after an appeal

My oringinal Attorney refused to handle my appeal in my personal injury case. I had to pay another attorney to handle the appeal now my original attorney says he is intitled to a third of the adjusted amount I was awarded in my appeal even thought he had nothing to do with it. I'm quite willing to give him the third from the original settlement but is he intitled to a third of the adjusted amount awarded by the appeal court?

Thank You

Re: Legal fees after an appeal

Usually your agreement is 1/3 of any and all sums recovered.

Usually the retainer agreement will state that the appeals are subject to a further/other agreement. In this case that appears to be another attorney.

The two are not intertwined...usually. But...read your retainer agreement for more information. That is what governs the 1/3 amount.

Good Luck
