Legal Question in Personal Injury in New York

Can you sue a person who is unemployed? If so, how does that work, do you garnish future wages?

I do not know what area of law my situation is in.

You can sue a person who is unemployed. After you receive a judgment, you can garnish wages in the future, place liens on assets, etc. A judgment lasts many years.
