Legal Question in Personal Injury in New York
I work at a private yacht club that runs a day camp. I am a counselor for a group of young kids. We were going on a field trip with a rented bus company and we ended up getting in a pretty bad accident. None of the kids were hurt but I was. I hurt my neck pretty bad and had to go to the hospital (no Ambulance, just by choice because of the pain). This incident was about two weeks ago and I still have pain but nothing was broken. I'm only 18 but I'm wondering if it would be worth it to sue the bus company. Years down the road I'm not sure if my injury will persist or if it will cause other issues. Should my family consider suing?

You would actually have 2 claims...first a workers' compensation claim as you were injured on the job and a second claim against the bus company. I woukd be happy to give a FREE consultation to review your rights and obligations. Feel free to contact me at [email protected] with your contact information. Best regards.
Workers compensation will cover your lost wages and medical expenses. Better to be represented by a WC attorney in order to get the full benefit of the claim. If your injuries turn out to be "serious", and that is defined in the law, you can pursue a pain and suffering case against the bus company and owners and drivers of any other vehicles involved in the accident. You have three years from the date of the accident to bring suit, so no hurry. Wait and see how you're feeling a month or two from now, and whether the course of medical treatment is extensive. If you're still in pain, you should be seeing a doctor. VTY, MEZ
You have 30 days from the date of the accident to file for no-fault benefits in NY, if your medical bills will not be covered under workers compensation. If you have a car in your household, you may want to file a no-fault application to insure that your hospital and medical bills will be covered. If you are hurt, get medical treatment, you may have sustained a serious injury. If you want to pursue a claim, call our office at 718-616-1414 for a free no-obligation consultation.
