Re: Commercial real estate

Generally, the answer is no. See, North Main Street Bagel Corp. v. Duncan, 37 A.D.3d 785, 831 N.Y.S.2d 239 (2 Dept 2007). However, a Court recently ruled that the landlord may shut off the electricity. See, Drapaniotis v. 36-08 33rd Street Corp., 48 A.D.3d 736, 853 N.Y.S.2d 356 (2nd Dept. 2008).

Re: Commercial real estate

Have you spoken to your landlord with regard to obtaining a new lease?

Does your old lease include any language about what will happen when it expires?
