Legal Question in Real Estate Law in New York
How to share real estate with sibling who thinks its his....
If I am appointed administrator thru the court -- how long will it take for my only sibling to find out I did this. My dad died leaving property only in his name but my brother is telling me I shouldn't be entitled to it since he has no job. The rest of the assets (cash also) are in my brother's name -- he is willing to split it but hasn't yet - should I go to court now before he gives me the money. The property is worth a lot and is only in my Dad's name. If he finds out I went to court to be sure of my half of the house he may not give me the money I am entitled to. I really wanted to maintain a relationship with my only brother but he really believes this house involved should be his. I was the sole caregiver of my Dad for 15 years until I got sick - my brother took over for 6 months and changed everything into his own name. HELP.

A. Immediately. You cannot be appointed administrator without giving your brother notice.
