is it legal for a 18 year old to date a 16 year old even if they never had sex and hes going to court for sexual misconducked?

An 18 year old can date a 16 year old, especially if they are not having sex. It may hurt the sexual misconduct case, it could help it. It depends on the 18 year olds maturity, willingness to treat others with dignity and the 16 year old's maturity and her ability to hold her own in the relationship.
