Legal Question in Sexual Harassment in New York

obscene sign

A construction worker at the building next door, nailed a sign with an obscene message across my window. Following a complaint to the manager, it was removed. Was the sign illegal? actionable?

Re: obscene sign

The sign in and of itself may not be actionable but the acts of trespass and destruction of property are actionable. You could have had him arrested. Whether you can sue him is another story. The other problem is that a case like yours isn't worth enough to make a law suit a viable option.

To be honest, you probably do not have a strong case. Part of your duty is to prove you suffered damages and based on the fact it was removed right away, then it would be hard to suggest that you suffered any harm.
