Why can't I claim my chid in taxes?

I was legally married until december 2000. I have a 10 year old boy. I keep claiming him in my income tax return, and the IRS keeps telling me that someone else claimed him. They ask for all sorts of papers to prove that i have legal custody and that he lives with me, and I haven't gotten credit since 2001. They refuse to tell me who claims him and i susppect that is my ex-husband, but he denies it. I have done everything that i could to stop this, but nothing is being done. This year the same thing happened when i filed my taxes. Can i go to criminal court for this, since the IRS is not doing anything to help me for the last 7 years!

In all events, you must establish that you provide at least 50% of the support for the child in order to substantiate your claim.
