Legal Question in Tax Law in New York

how should I file my taxes?

My wife and I used to file married filing separate returns each claiming one of our sons. She recently past away but she worked for 6 months or more. Do I have to file her taxes together with mines or should I just file my taxes and leave hers unclaimed.

Re: how should I file my taxes?

You have your choice, as you did while your wife was living. You may file a joint income tax return or file separate, individual income tax returns. If you file individual returns, your income tax return will be for the full calendar year 2006 and that for your wife will be for the period from January 1 through the date of her death.
