Re: When is a Letter of Administration required?

Under what circumstances would a letter of administration be required tro file a IRS 1040 tax return and Quarterly Estimated Taxes for a deceased person who appointed 2 co-executors in her will? The will has not been probated, since the only asset was a half interest in a house still occupied by a co-owner related to the co-executors.

Letter of Administration would be necessary in order for you to file estate taxes. In addtion, given that real property is involved, I would highly recommend that you file for probate and letters of administration.
