Legal Question in Tax Law in New York

got letter for tax audit

Own a deli and been a corporation for 6 years. Just received for tax audit letter and have only 2 weeks to prepare. What will the tax auditor examine? What do I need to prepare and is my accountant's presence will help me? Do I need to hire a lawyer for the best outcome? Plse help me.

It is generally desireable to have your accountant handle the audit. If your accountant is experienced in this field, he will know how to prepare.

Generally, a lawyer is called in if a technical issue is raised and expertise is needed to resolve the matter.

The initial, and perhaps only, meeting with the agent involves a review of the financial records for the tax years identified in the notice.

I agree with Norman. It has been my experience that the client should not attend, as he may say something improper, and his accountant should have all the information. The letter should have specified what items or information is being questioned, so all material pertaining to the issue(s) raised should be available. Since you have the right to appeal any determination that you disagee with, I do not think an attorney is needed at this time. Depending what is raised or determined, an attorney can be brought in at the next level of discussions.
