Legal Question in Traffic Law in New York
is speeding innocent until proven guilty?
hi i was pulled over for speeding 20 miles over the limit recorded by radar.
Q- if im innocent until proven guilty doesnt the cop have to prove that it was my car that was speeding.
what if i can deny the claim and say that there was another car which was the same make and model in front of me that was speeding and the cop got mixed up?
isnt the burden of proof on them?
or, is traffic court different then criminal court?
thanks for your time,
sincerely

They still have to prove their case. But how will you prove it was not your car..that burden falls on you.
Good Luck
