Collection on a deceased persons bills

My dad passed 2 yrs ago- he had nothing, no will, no home, no savings- nothing. One company has been hassling my mother and I about paying a balance on a loan he took on his own.

The have gotten all the credit information wrong- saying he had 2 cars, a house, etc. All other bills have been written off or dismissed- are we liable for this? I keep asking to see the orginal docs and they dont send them. Now they are telling me it will be going to probate.

If the debt was not guaranteed, then the creditor can only seek payment of the debt from the assets owned by your father at the time of his death. The creditor has the obligation to find the assets claimed to exist. Neither you nor your mother has any responsibility for payment.
