Legal Question in Wills and Trusts in New York
Can I go to court without a lawyer
I'm having a problem with the executrix of my mothers estate, which is my sister. Due to a poorly written will i believe she is taking advantage of her position and is not honoring my mothers will in the beneficiaries best intrest! I want to take her to court but am afraid my younger sisters and myself cannot afford a lawyer. Is there any way i can ask for a hearing with the surrogates court judge without hiring a lawyer? I have consulted a lawyer and was told i do have a case but it would cost me a retainer of $3500 dollars and the rest would be paid out of the estate.

Speak to a clerk at the Surrogate's Court. They can be very helpful.
As a lawyer, I earn my living by giving advice and taking action. If you need professional guidance it will cost you money. Your choice is whether the fees you pay to the lawyer are less than what you will gain by making your sister toe the mark. Tough choice, but one that people make every day.
In response to your question, yes you can go to court without a lawyer, and the Surrogate will be quite sympathetic.
