my dad had a life insurance policy which my mom was left beneifacy she passed away 18 years ago my dad passed away this year [2010]does this policy in the state of ny go to his estste or to their children from their marriage

The first place to look is to the insurance policy to determine if there is a contingent beneficiary. If there is none, the proceeds will go to your Dad's estate.
