Legal Question in Wills and Trusts in New York

Dealing with an imcpetent attorney

Simple will taking almost 5yrs to settle. Final accounting done & shows exectutor as putting $4k in

estate (and getting it back last yr) to pay attorney when in actuality the son of deceased paid and has the check to prove it.Son also pd the executor (his

uncle)$3k in commission, estate State Tax of $4K (getting refunded due to attorney using an imcompetent accountant who used an outdated form).Estate Attny takes 3-4 months to return calls etc. What can we do. Executor was paid the $4k last plus last year, attorney keeps adding money to his bill- we need help. The Estate attorney is totally imcompetent, the executor cashed a check he knew he wasnt owed. We need help-where do we go,already been through 2 attorneys-running out of money. Where can we go?

Re: Dealing with an imcpetent attorney

I would suggest that you contact an attorney who handles "legal malpractice" cases. I can't tell you if the estate attorney committed malpractice because it is not clear cut, and I don't have enough facts. Good luck, and I really hope you can get some relief.

Hire a good attorney.

In the long run it is cheaper.
