Death & assets
If there is no will, in the State of New
York, do the assets of a husband or
wife go to the surviving spouse , in
the event of a death of either one ?

If there are no children surviving the decedent, then all of the property goes to the surviving spouse. If there is/are children, the first $50,000 and roughly 1/2 of the excess goes to the surviving spouse and the balance is divided among the children.
