Legal Question in Wills and Trusts in New York
Estate Money
I am 1 of 2 adopted children. We were not included in the sell of my adopted parent's estate by the biological children. There was no will. The estate's assets have been settled and all money was distributed among the biological children. We want to know if there is any chance of getting our share of the assets if there is no money left. Can we file a petition against them, and if so how will we obtain our share if all money from each biological child has been depleted? Can we file individual petitions. Can the courts put liens on their accounts or garnish their wages?

Re: Estate Money
Based on the information that you furnished, it is clearly evident that you do have rights and you should take steps to protect and enforce them.
In New York, by statute, adopted children and biological children are treated equally.
I strongly recommend that you consult with a competent lawyer.
