Estate Tax Waiver

When my husband passed away in 1989 I did not have to

probate his will because I thought everything was jointly

held. Several years later I tried to refinance my coop and found out that Title to our Co-op did not read ''jointly

held with right of survivorship''. Now my coop is asking for an Estate Tax waiver for NY State in order for me to have my husband's name removed from the deed for my co-op. I no longer have any documents (except his will, on file with the Surrogates Court). How can I resolve

this dilemma?

Proceed with the probate of the Will and have the executor attend to the transfer of the unit to you, if that's what the Will provides.
