Legal Question in Wills and Trusts in New York

executer fee

I am the executer of my father's estate. The will stipulates that the assets be distributed equally between my brother, sister, and myself. I know that the executer is entitled to a fee. I will be handling the bills, the selling of the house and car, notifying Social Security, his pension, etc. I want to be fair. Is the fee a set amount or a percentage of the total estate?Thank-you.

Re: executer fee

Executors are entitled by law to receive the commission specified in section 2307 of the Surrogate's Court Procedure Act.

5% of first $100,000;

4% of the next $200,000;

3% of the next $700,000;

The percentages are based on the gross estate values.
