Will was filed for probate in surrogate court early in 2004.

It has still not been ''settled''

Are there ''time limits'' on how long an executor can take to complete

his duties?

I assume the will has been probated. The Executor must move at a reasonably swift pace, however, if he functions to slowly, you may, as a beneficiary, apply to the Surrogate for an order directing that the Executor file an account. The filing of an accounting brings about the final settlement of the estate.
