Legal Question in Wills and Trusts in New York

executor of estate

My brother is the executor of my father's will and estate. He has sold the family home, but despite the fact that I am listed in the will as being the beneficiary of 50% of all assets, he has said that our dad told him to hold my money in trust. Our dad never mentioned this to me, and it is not in the will either. As executor, does my brother have the legal right to withold dividing the estate?

Your brother is bound to follow the provisions of the Will. Verbal instructions are not binding.
