Legal Question in Wills and Trusts in New York

home but in trust, upon being benificary does lein have to be paid

My mother passed away in l995, my father put the house in a trust. The home has a judgement on it. Upon the passing of my father, I being the beneificary of this trust, will the judgement on this house have to be paid? Or do I just keep the trust in my fathers name and not sell the house?

The encumberance will stay on the house whatever you do. The holder can foreclose, if he wishes, and it will have to be discharged before you can pass title to a buyer.
