letter of testimentary and executor

mom died recently. she did'nt have a will or designate any of 3 adult children to collect her apartment rent security, bank funds under 1000. i'm child 2. do we need to have testmentary, executor, and probate to collect funds? they want me to handle this.

Any one or all of you should petition to be appointed as the Administrator of your mother's estate. You can check with one of the clerks at the Surrogate's Court and I am sure that you will get helpful advice.

You qualify for a small estate administration. This is a fairly simple form that may be completed at the Surrogate's Court. You should go to the clerk at the local Surrogate's Court and inquire.
