Legal Question in Wills and Trusts in New York

My mother owns her own home. The deed is in her and my father's name. (my Dad is deceased) Upon her passing, what will happen to the house? She does not have a will. My sister and I would like to know. Thank you.

Her estate must go through Intestate Administration. Ultimately, a deed could be filed for you and your sister.

I agree with the last two answers. Your mother should consider going to a wills/trust attorney to discuss protecting your interests in the house should she have to go to a nursing home, she gets sued and loses, or she dies intestate.
