Legal Question in Wills and Trusts in New York

probate

Does anyone know if the executor of the will is legally responsible to notify the sibilings of the deceased? If they do not, is there legal action that can be taken against them?

Re: probate

It all depends on the facts. If a sibling would be entitled to a portion of the estate if there was no will, then notice must be given to the sibling. On the other hand, if the decedent is survived by children or a spouse then there is no obligation to notify a sibling.
