Legal Question in Wills and Trusts in New York

Probate wills

What forms or documents are necessary to probate a will...there are no family survivors and the deceased assets consist of a checking account worth approximately $7,000. The bank put a hold on the account until the will is probated. I need to know what forms or documents to take to the court to proceed and finalize.

Re: Probate wills

A petition, signed by an interested party, starts a probate proceeding. The petition is to be filed in the county in which the decedent was domiciled.

Generally, any person with an interest in the estate can sign the petition.

What is your interest in the estate; executor, friend, creditor, distant relative??

It may be possible to probate the Will in Florida.

If there is no Will, then Administration is the course to foillow.
