The reading of the Willis found only in movies and television shows; it just isn't done any more. A lawyer is not essential but is well worth the fee if there are complications.

The old custom of having the family lawyer "read the will" to the gathered relatives of the decedent is no longer followed in New York. There are other ways of assuring that everyone who is entitled to know about the will gets that information. Most families, however, do need a lawyer to help them through the probate and administration of the estate. Over the years, these processes -- intended to protect families against fraud -- have become quite complicated. Dear sir or madam:

Actually having the attorney read the will is a rare occurence.

However, depending on the size of the estate, you may need an attorney's assistance for filing probate, distributing assets, and filing proper income, estate income, and estate tax returns.

In a brief word - no. You can even handle the probate yourself. However, depending upon what assets comprise the estate, how they are to be distributed, what documents may be needed, what final income taxes or possible federal or estate estate or inheritance taxes may need to be paid, etc., there may be a need for an attorney's assistance. Since you do not provide alot of specifics on what is involved, a better answer may be - maybe!
