Legal Question in Wills and Trusts in New York

not having a will

Without a will in NY State, how does the estate get distributed? Divorced first wife but had 3 children, second wife is claiming whole estate, they had no children... don't the children get 2/3 and wife 1/3 ?

Surviving spouse gets the first $50,000 and everything over that amount is divided 50% to spouse and 50% among children
