will not probated
If you know you are in a will but the executor has not probated it what can be done? It has been 10 months since the person whose will it is died and it has not been probated yet.

If you know the person in possession of the Will, you should consider going to the Surrogate's Court to request an order directing the person who possesses the Will to submitt it to the Court. Incidentally, have you spoken to the person who has the will to find out why it has not been submitted for Probate?
