Legal Question in Wills and Trusts in New York

No Will Provided

My mother died recently in a fire all her papers and everything else was destroyed. She left no will. My question is this I know she had considerable savings in Cds and such and I believe my younger brother is the beneficiary on these accounts but what about her other 2 children do we have a right to any of the money?

Your mother intestate (no will). An administrator needs to be appointed-all children qualify but can agree that less than all need to qualify. Any asset not having a specifically named beneficiary (e.g., CD's in her name only) are split equally among the children.

The CD's, etc. that have a beneficiary go to the beneficiary if there is a right of survivorship.

The children inherit only property owned by your mother outright and individually (that is, with no co-owner).
