Legal Question in Wills and Trusts in New York

if a will for a single person with adult children is used but the person wants to leave his kids nothing, does he need a different type of will or does he just need to fill out an ammendment??

I urge you to see an attorney about this. Especially if you are trying to disinherit your children, you should hire an attorney who can explain how best to get the results you are seeking. If you amend a will without following the correct rules, you may make the entire will invalid in which case the children will surely get at least part of the inheritance.

I concur with the answer and suggestion. It is not the form but the language that accomplishes this. You provide no information as the reason for the disinheritance, who will receive the estate and the relationship of this person to the Will maker, as well as why this is being done. Answers to these questions and properly covered in the Will may avoid litigation later.
