Legal Question in Wills and Trusts in New York

Wills & Probate

My sibling and I are co-executors of my mother's will. He lives in NY state, I live in Nevada. I just rec'd 2 forms, a Renunciation of Nominated Executor and Waiver of Process;Consent to Probate. Should I sign these if I don't totally trust my sibling?

Re: Wills & Probate

If you don't trust your sibling, why on earth would you renounce serving as an executor??????????

Insist on being appointed as a co-executor so that you will be able to hire your own attorney (paid for by the estate) and participate in all decisions.

If you don't trust your sibling it would be a mistake to give up your rights, but you may need to present in NY State to proceed as executor. It would be a good idea to hire in-state counsel on your behalf.

Should you like to discuss this or any other legal matter, you can e-mail me for more information about low cost face-to-face, on-line, or a telephone consultation with a lawyer in our office.
