Legal Question in Workers Comp in New York

I lost the left front wheel off my company vehicle on an interstate highway, thus slamming into both guard rails, but no other vehicles. I sustained severe neck and shoulder trauma, and have received workers compensation benefits; however I believe I have a case to sue my company. They maintain their own vehicles and actually fired the mechanic who performed the most recent wheel- bearing service. However, since that service was performed four years ago, the union got that employee re-instated. Due to the excessive amount of miles put on these 1980s vehicles, I feel that this wheel coming off is due to negligence for which I should be duly compensated.

Worker's compensation prevents you from suing your employer. If the work was negligently performed by an outside vendor, you might be able to sue them.
