Legal Question in Workers Comp in New York
if my case is still open from my original injury, two years ago and i miss work from that injury. do i need to file a new claim for that injury, and do i still need to wait the 10 days before collecting from comp?

No you do not. If you already passed the waiting period requirement then your case will not be DILWP'd (disability is less than the waiting period). If you injured your extremity (hand, foot, leg, hand, eyes, ears, etc.) then you could be entitled to a schedule loss of use award.
