Legal Question in Workers Comp in New York

didnot receive my WC payment as of yet

How long /or late or howmuch time to pass before I can do er sometime beside calling lawyer, does the insurance Company have to pay on a claim that is 5 years old?

I cannot really tell you why they haven't paid you. Your post doesn't give a lot of details that would be necessary to answer that question. Generally there is no time limit for them to pay unless they have been ordered to pay something by the WC Board. Typically insurance companies are not interested in paying voluntarily so it is usually up to the Claimant to force them to pay, typically by requesting a hearing. It sounds odd that you have gone 5 years without being paid anything, if you are out of work due to that injury. You should know there are very definite time limits running against you if you do not request a hearing or file a request for payments. You really should not be afraid to call a lawyer to look into the matter. A case that is five years old, with no payments ever being made, is bound to have a lot of issues that you would not be aware of on your own. A lawyer would do a detailed file review and give you a more specific answer than you could possibly get over the internet. Consultation is free and attorneys fees are paid by the insurance company, out of the money they owe you. If there is nothing payable to you, the lawyer gets nothing. Most experienced compensation lawyers, who have been practicing for than 10 years or so are really in it to help people more than for the money so you really shouldn't be afraid to give one a call.
